Terms and Conditions
These Terms and Conditions govern the sale of trees, the use of our website, and related services provided by Underground Trees Ltd and undergroundtrees.co.uk (hereafter referred to as “we”, “our”, or “us”).
By placing an order with us, you (“the customer”) agree to be bound by these Terms and Conditions.
1. Orders
1.1 Orders must be submitted in writing via email or through our online shop.
1.2 All orders will be acknowledged in writing. An order is not considered accepted until we issue written confirmation.
1.3 We cannot be held responsible for orders that have not been acknowledged by us.
2. Product Description and Pricing
2.1 Due to the nature of our products, natural variations will occur compared to photographs or descriptions on our website or social media. Factors such as growth habits, climatic conditions, and seasonal changes can affect appearance.
2.2 We make every effort to provide accurate descriptions but cannot guarantee products will exactly match descriptions or images.
2.3 We are certified organic by the Soil Association, and our trees are suitable for use in certified organic production systems.
2.4 Prices are as listed on our website or provided in writing via email. We reserve the right to update prices at any time.
2.5 The final price will be confirmed in our order acknowledgment.
3. Payment
3.1 New customers must make full payment before goods are dispatched.
3.2 We accept payment via credit and debit cards (through our website) and via bank transfer.
4. Delivery
4.1 We are not liable for losses arising from incorrect delivery addresses provided by the customer.
4.2 We are not liable for losses, damages, or delays during transit caused by third-party couriers.
4.3 We are not liable for any consequential loss to the customer or third parties resulting from a delivery delay.
5. Returns and Refunds
5.1 Any issues with delivered goods must be reported to us in writing within 7 days of receipt.
5.2 Returns will only be accepted with our prior agreement. Returned goods must be undamaged and fit for resale.
5.3 Refunds will only be issued if we deem returned goods to be in a resaleable condition.
6. Cancellations
6.1 Orders cancelled after confirmation may be charged in full.
6.2 Refunds or returns for cancellations will only be considered at our discretion and must be agreed in writing.
7. Liability
7.1 We take care to supply healthy, resilient trees, but we cannot guarantee their performance after planting due to factors beyond our control (e.g., soil conditions, climate, care).
7.2 All complaints must be made in writing within 7 days of receipt of goods. Failure to do so will be deemed acceptance of the goods.
7.3 Our liability is limited to the purchase price of the goods supplied.
7.4 We make no warranties regarding the accuracy of information on our website or social media channels and accept no liability for reliance upon such information.
8. Force Majeure
We are not liable for delays or failure to deliver due to events beyond our reasonable control, including but not limited to adverse weather, transport disruption, labour disputes, or supplier delays.
9. Intellectual Property
All content on our website and social media, including text, graphics, logos, images, and software, is the property of Underground Trees Ltd or its content suppliers and is protected by UK and international intellectual property laws.
No part of our content may be reproduced, copied, or otherwise exploited for commercial purposes without our express written consent.

11. Governing Law
These Terms and Conditions are governed by Scottish law, and any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
12. Amendment of Terms
We reserve the right to amend these Terms and Conditions at any time. Updates will take effect upon being posted to our website or communicated directly to you. Continued use of our services or purchase of our products constitutes acceptance of any changes.
